Scope and Purpose of the General Conditions of the Store
Together with the order form and other elements referred to therein, these clauses aim to regulate the terms and conditions governing the provision of the “JM Graphics Online Store” service by “JM Graphics Unipessoal Lda,” a limited liability company, registered at Rua da Suécia, 56, BL E, 4820-205 Fafe, NIPC 514 525 029.
The “JM Graphics Online Store” service, through the website www.jm-graphics.com, provides access to the Online Store.
This website not only provides information about a range of products and/or services but also allows the User to order the products explicitly displayed there, under the terms and conditions described in these conditions.
Product and/or service orders must be placed by Users who are 18 (eighteen) years of age or older. Minors, with the authorization of their legal representatives, may place orders. The information and data transmitted by the User shall have full legal effect, with all electronic purchases they subscribe to being recognized, and they may not claim the lack of a signature as a reason for failing to comply with the obligations assumed.
Product Information and Content
JM Graphics Unipessoal Lda will make every effort to ensure that the information displayed online is free from typographical errors, which will be promptly corrected when they occur.
If the User acquires a product and/or service that has characteristics different from those presented online, they have the right to resolve the purchase contract, under the applicable legal terms.
JM Graphics Unipessoal Lda will make every effort to ship all ordered products within a reasonable period. If any unforeseen circumstances arise that are not attributable to the “JM Graphics Online Store,” such as human error or a failure in the computer system, which prevent the availability of the product ordered by the User, JM Graphics Unipessoal Lda cannot be held responsible for any material or moral damages incurred by the User.
In other cases where the product is unavailable after the User has placed the order, the order will be notified via email or phone, so that the customer can cancel the order and request a refund if payment has already been made, or choose a similar product of equal value.
Additional Charges and Fees
Preview Fee:
A non-refundable preview fee will be charged before any graphic design work begins, if the customer opts for this option when purchasing a product. The fee covers the preliminary design revision and is applicable regardless of the final result of the product. It will not be refunded under any circumstances, even if the customer decides not to proceed with the order.
Bespoke Customization Fee (Custom Graphic Design):
A bespoke customization fee will be applied only to all custom design services, both for individuals and businesses, offered by the “JM Graphics Online Store,” if the customer opts for this option when selecting a specific product. This fee is included in the total final order value, covering the time and resources required to create the designs. After the personalization work begins, this fee will not be refunded, even if the work does not meet the specifications provided at the time of the order, unless there is an error attributable to JM Graphics, Unipessoal Lda.
Payment Fee Refund Policy:
In case of defective products or services, the User is entitled to a full refund of the amount paid, including the cost of the product and/or service. If the customer requests a refund before the order enters production, the total amount paid will be refunded, except for the payment processing fees charged to us, which are non-refundable, even in the case of a refund request.
User Obligations
The User agrees to:

Provide correct personal data and up-to-date addresses;

Not use false identities;

Respect the order limits imposed.
If any data provided or indicated by the User is incorrect or insufficient, and as a result, there is a delay or inability to process the order or deliver the product, the User will be responsible for the resulting damage, and JM Graphics, Unipessoal Lda will not be held liable for it.
If the User violates any of these obligations, JM Graphics, Unipessoal Lda reserves the right to interrupt future purchases, block access to the “JM Graphics Online Store,” and prevent the User’s access to any products and/or services provided, as well as cancel the supply of any other product and/or service to that User.
The use of products and/or services acquired on the “JM Graphics Online Store” for unauthorized commercial purposes by JM Graphics, Unipessoal Lda is strictly prohibited.
Order Cancellation
By User Request:
The User may cancel the order by requesting it from JM Graphics, Unipessoal Lda, via phone or email, indicating the order number, as long as the order has not been processed yet. After processing, the order cannot be altered or canceled, and JM Graphics, Unipessoal Lda will proceed with the delivery since all products are customized according to the request made by the User.
To proceed with the order cancellation before processing, the User must provide the following information to JM Graphics, Unipessoal Lda:

Order number;

VAT number (NIF) used to place the order;

Delivery address for the order.
Returns
Since JM Graphics, Unipessoal Lda only designs and produces customized products for each User, it commits to fully reproducing the request made by each User.
JM Graphics, Unipessoal Lda is not responsible for spelling errors or other mistakes attributable to the User, as well as for minor variations in color tones that may occur during the production process. Therefore, the User is expressly excluded from the right to withdraw from the order as stated in Article 17, Paragraph 1, item c) of Decree-Law No. 24/2014, of February 14 (due to the supply of goods made according to the User’s specifications or clearly personalized).
Shipping
At the moment the order is placed by the User on the “JM Graphics Online Store,” during the shipping of the order, the risk of loss and/or damage to the product is transferred to the carrier hired for that purpose. Upon receiving the product (when signing the receipt), this responsibility will be transferred to the User.
Payment
Payment for the ordered product and/or service on the “JM Graphics Online Store” can be made via Paypal, MB, Visa, or Mastercard, and must be made on the date of the order. The User guarantees that the payment method used has sufficient funds to cover the order costs, and JM Graphics, Unipessoal Lda reserves the right to validate this before processing any order.
The price of the product and/or service will be as shown on the “JM Graphics Online Store” page at the time of completing the order.
Upon completing the order and payment, the User guarantees that all provided data for product personalization is correct and meets the requested requirements.
